At Taste of Nature Foods Inc. (“Taste of Nature Foods”), we respect your privacy. Our privacy policy (“Privacy Policy”) tells you what personal information we may collect, and how we use and disclose this information. This Privacy Policy also describes other important topics relating to your privacy.

By using the Taste of Nature Foods website at TasteofNature.com and FindYourTasteofNature.com (the “Site”), or by choosing to submit personal information to Taste of Nature Foods, you signify your consent to all of the terms of this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not use our Site or submit any personal information to Taste of Nature Foods.

Taste of Nature Foods reserves the right to change this Privacy Policy at any time. We will reflect any changes to this Privacy Policy on our Site and will indicate the date this Privacy Policy was last amended. Your continued access to and/or use of the Site after any such changes constitutes your acceptance of, and agreement to, this Privacy Policy, as revised. Therefore, please periodically review this Privacy Policy so that you know what personal information we collect, how we use it, and with whom we may share it.

1. About Us and this Privacy Notice

This Privacy Notice is provided by Taste of Nature Foods Inc., a company incorporated in Canada under Registry ID 1878102 with registered office at 230 Ferrier St, Markham, ON L3R 2Z5, Canada, who is a 'controller' for the purposes of the General Data Protection Regulation (EU) 2016/679 ("GDPR").

This Privacy Notice applies to, former and current, website users, customers, suppliers, participants who enter into competitions or respond to surveys.

2. Privacy - Data protection principles

We respect applicable principles in the context of personal data processing operations. In particular, the data are:

  • relevant to the purposes for which they are collected and limited solely to those purposes;
  • accurate and kept up to date;
  • kept safe and for a period not exceeding that necessary for the purpose of collection.

3. What Personal Data Taste of Nature Foods Collects

Personal Data is information about an identified or identifiable individual, such as your name, address, telephone number or email address (“Personal Data”). We collect Personal Data when you voluntarily provide it through our Site, or when you provide it to us through other means. We collect the following Personal Data from you:

  • If you request to receive email, offers, or marketing communications from Taste of Nature Foods, we will collect your full name, email address, telephone number, language preference and country;
  • If you download an offer, a coupon or other material from our Site, we will collect your email address;
  • If you participate in a contest we run, we will collect full name, email address, language preference physical address and phone number;
  • If you contact us through e-mail, telephone, mail; or other correspondence, we will collect full name, physical address and phone number if this is necessary to deal with your request or provide any services requested by you; or

4. How Taste of Nature Foods Uses and Discloses Personal Information

The Personal Data we collect will be used by Taste of Nature Foods for the purposes for which it was collected, as provided in this Privacy Policy, or for other purposes that are disclosed to you at the time of collection and to which you have consented where consent is necessary. We are allowed to do so on certain legal bases (please see section 'How is processing your personal data lawful' for further detail).

We use your Personal Data to:

  • Supply you with informational or promotional communications on Taste of Nature Foods products, services or programs, or the products, services or programs of trusted third party advertisers;

  • To help us learn more about your shopping preferences;

We will only use your personal information for the purposes for which we collected it or compatible reasons with the original purpose. Any change of purpose will be notified to you.

If you have provided us with your Personal Data for the purpose of being provided with information or commercial messages, but later decide you no longer want us to send you any information or commercial messages, you may unsubscribe by using the unsubscribe message in any of our commercial messages.

5. How is Processing Your Personal Data Lawful?

a. Insofar as we obtain the consent of you for the processing of Personal Data, the legal basis is Art. 6 para. 1 lit. a GDPR.

b. The legal basis for the processing of Personal Data required for the performance of a contract to which you are a party is Art. 6 para. 1 lit. b GDPR. This also applies to processing operations that are necessary for pre-contractual measures.

c. Insofar as the processing of Personal Data is necessary to fulfil a legal obligation to which our company is subject, Art. 6 para. 1 lit. c GDPR is the legal basis.

d. If the processing is necessary to safeguard a legitimate interest of our company or a third party and if the interests, fundamental rights and fundamental freedoms of the person concerned do not outweigh the first interest, Art. 6 para. 1 lit. f GDPR is the legal basis. We process Personal Data based on a legitimate interest:

  • To help us learn more about your shopping preferences;
  • To help us address problems with and improve our Site design, products and services;
  • To post a rating or review you have provided us on our Site, social media sites.

You can object to processing that we carry out on the grounds of legitimate interests. If you do so, we will no longer process the Personal Data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or if the processing occurs for the establishment, exercise or defence of legal claims.

6. Who Will Have Access to Your Personal Data?

We may transfer your Personal Data to third party service providers that act as our processors and assist us with carrying out the purposes listed in this Privacy Notice. For example, we may use a third party to help us host our Site or organize marketing operations.

We reserve the right to transfer any Personal Information we have about you in the event that we merge with or are acquired by a third party.

We may also disclose your Personal Information to third parties if we have reason to believe that disclosing such information is necessary to: (i) conduct investigations of possible breaches of law; (ii) identify, contact, or bring legal action against someone who may be violating an agreement they have with us; or (iii) to protect our rights, safety or property. Lastly, we may disclose your Personal Information for any other purpose to which you consent.

Please note that the Personal Information we collect online may be combined with information you have provided to Taste of Nature Foods through other sources if you have given us your consent to do so.

The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties.

7. Cookies and How Taste of Nature Foods Collects Information Through Technological Means

When you visit our Site, we may collect information that is automatically sent to us by your web browser or your internet service provider.

The legal basis for processing Personal Data with the help of cookies is Art. 6 para. 1 lit. f GDPR.

8. How we Protect Personal Information

The security of your Personal Information is important to us. We maintain physical, organizational and technological safeguards intended to help protect the Personal Data we hold against unauthorized use, disclosure or access. Personal Data may be accessed by persons within our organization, or our third party service providers, who require such access to carry out the purposes described in this Privacy Policy, or such other purposes as may be permitted or required by the applicable law. Personal Data we collect, namely full name, email address, language preference physical address and phone number, is maintained with the source of the information in the United States.

Although we have taken measures to help protect our Site, computer systems and any Personal Data that we have collected from unauthorized use, access, disclosure, misuse, alteration or destruction, no security measures can provide absolute protection.

9. Transfer of Your Personal Data Outside the European Economic Area ("EEA")

As a company located in Canada, we will need to transfer your Personal Data to Canada. Any transfer of your Personal Data will be carried out in accordance with the law to safeguard your privacy rights and give you remedies in the unlikely event of a security breach or to any other similar approved mechanisms. In case of Canada, there is an adequacy decision of the European Commission pursuant to Directive 95/46/EC which avails under article 46 of the GDPR.

Some or all of the Personal Data we collect may be stored or processed on servers located outside your jurisdiction of residence, including in the United States, whose data protection laws may differ from the jurisdiction in which you live. As a result, this information may be subject to access requests from governments, courts, or law enforcement in those jurisdictions according to laws in those jurisdictions. Subject to applicable laws in such other jurisdictions, we will use all reasonable efforts to ensure that appropriate protections are in place to require the data processor in that country to maintain appropriate protections on the Personal Information. In case of the United States, we ensure that the relevant company has entered into a data transfer agreement containing clauses offering an adequate level of protection according to the European Commission, has adopted corporate binding rules, benefits from the U.S. "Privacy Shield" accreditation or has otherwise implemented appropriate safeguards.

10. When Will We Delete Your Data?

Our main rule is not to keep your Personal Data for longer than we need to in order to meet all the purposes we included in the section "How Taste of Nature Foods Uses and Discloses Personal Information". For example, if you buy our products on line, we will keep your Personal Data for 3 years from the last order, unless a longer storage period is required by applicable law, such as commercial or tax law.

Personal Data of visitors to our website will be erased if and when they are no longer necessary for the purposes described in this Data Privacy Policy, unless a longer storage period is required by applicable law. Data about your use of our website generally will be stored for a time period of 12 months from the collection. Information you enter into the contact form will be erased as soon as your inquiry has been fully processed. Newsletter subscription data will be stored until you unsubscribe from the newsletter.

11. Your Rights

As a data subject, you have the following legal rights:

  • Right of access to personal data relating to you
  • Right to correct any mistakes in your information
  • Right to ask us to stop contacting you with direct marketing
  • Right to restriction of processing in some circumstances
  • Right to object to processing of your data where processed on the grounds of legitimate interests
  • Right to data portability
  • Right to erasure in some circumstances
  • Right to withdraw consent
  • Right to organize the management of personal data after the death of the data subject
  • Right to file a complaint with the regulator

We will respond to any rights that you exercise within a month of receiving your request, unless the request is particularly complex and/or if we receive a high number of requests, in which case we will respond within three months. Please be aware that there are exceptions and exemptions that apply to some of the rights which we will apply in accordance with the Data Protection Laws.

Right to Access Personal Data Relating to You

You may ask to see what personal data we hold about you and be provided with:

  • a copy of the Personal Data;
  • details of the purpose for which the Personal Data is being or is to be processed;
  • details of the recipients or classes of recipients to whom the Personal Data is or may be disclosed, including if they are overseas and what protections are used for those overseas transfers;
  • the period for which the Personal Data is held (or the criteria we use to determine how long it is held);
  • any information available about the source of that data; and
  • whether we carry out an automated decision-making, or profiling, and where we do information about the logic involved and the envisaged outcome or consequences of that decision or profiling.

To help us find the information easily, please provide us as much information as possible about the type of information you would like to see. We may require you to verify your identity before we allow you to access your Personal Information.

Right to correct any mistakes in your information

You can require us to correct any mistakes in your information which we hold. If you would like to do this, please let us know what information is incorrect and what it should be replaced with.

Right to restriction of processing in some circumstances

You may request that we stop processing your personal data temporarily if:

  • you do not think that your data is accurate. We will start processing again once we have checked whether or not it is accurate;
  • the processing is unlawful but you do not want us to erase your data;
  • we no longer need the personal data for our processing, but you need the data to establish, exercise or defend legal claims; or
  • you have objected to processing because you believe that your interests should override our legitimate interests.

Right to object to processing of your personal data

You may object to us processing your personal data where we rely on a legitimate interest as our legal grounds for processing. If you object to us processing your personal data we must demonstrate compelling grounds for continuing to do so.

Right to data portability

You may ask for an electronic copy of your Personal Data which we hold electronically and which we process when we have entered into a contract with you. You can also ask us to provide this directly to another party.

Right to erasure

You can ask us to erase your personal data where:

  • you do not believe that we need your Personal Data in order to process it for the purposes set out in this Privacy Notice;
  • if you had given us consent to process your data, you withdraw that consent and we cannot otherwise legally process your Personal Data;
  • you object to our processing and we do not have any legitimate interests that mean we can continue to process your Personal Data; or
  • your Personal Data has been processed unlawfully or have not been erased when it should have been.

Right to withdraw consent

You may withdraw any consent that you have given us to process your Personal Data at any time. This means that we will not be able to carry out any processing which required use of that Personal Data.

Management of personal data after death

Pursuant to French data protection laws, you may provide directives about the handling of your personal data after your death.

Complaints to the regulator

If you do not think that we have processed your data in accordance with this Privacy Notice, you should let us know as soon as possible. You also have the right to complain to the relevant supervisory authority in your country.

12. Children and Parents

Taste of Nature Foods does not knowingly collect Personal Data from children without the authorisation from the parent or guardian. If a child has provided us with Personal Data without authorisation, his or her parent or guardian may contact us for the purpose of deleting this information.

13. Third Party Websites

Our Site may contain links to other third party websites. These other websites have their own privacy policies and terms and conditions that are not governed by this Privacy Policy. We are not responsible for the privacy practices or the content of any website(s) owned and operated by any such third parties. Other websites may collect and treat information collected differently, so we encourage you to carefully read and review the privacy policy for each website you visit. Any links from this Site to other websites, or references to products, services or publications other than those of Taste of Nature Foods, do not imply the endorsement or approval of such websites, products, services or publications by Taste of Nature Foods.
